Week 22 of the General Assembly ends with one of NCHBA’s top priority issues one step closer to enactment. While leadership of both the House and Senate vigorously debate (and huff and puff) about the budget, NCHBA continues to move our legislative agenda. Both the House and Senate approved a continuing resolution (CR) that sustains funding for state government operations at 85%. Much to the chagrin of the Senate, the House insisted that the CR be effective only until July 15. In agreeing to the terms of the CR, both bodies will put pressure on budget conferees to resolve their differences. By the writing of this update, the term “resolution” is not even in the dictionary for the budget conferees yet. Good thing the CR can be extended! One positive effect of budget deliberation by both bodies is review and debate of the revenue package, including the expanded sales tax on services and the expansion of the franchise tax to cover all LLCs. NCHBA is monitoring both of these provisions and has spoken to Senate and House leaders about the effect those taxes will have on our members. |

HB 852 Defer Tax on Builders’ Inventory received a unanimous favorable report from the Senate Finance committee on Wednesday. The bill was read in, but due to shortened Senate calendars to allow the budget conferees to meet more frequently, the bill will not be on the Senate floor until next Wednesday. Look for the opportunity to contact your Senator via Voter Voice next week!
HB 569 DWQ/Bridge and Culvert Standards received a favorable report from the Senate Agriculture and Environment Committee and will be before the full Senate shortly.
HB 1305 Beach Plan Changes received a favorable report by the House Insurance Committee on Tuesday. This bill contains some of the recommendations endorsed by NCHBA’s Legislative Committee, but the bill contains some provisions that we do not support at this time. NCHBA does not endorse the maximum assessment established in the bill at $1 billion. We do not endorse a catastrophic assessment recoupment of 10% statewide with no limit on duration. We do not support the requirement by the Beach Plan for flood insurance. The bill will go to the House Finance Committee next and NCHBA will state our position before that committee.
HB 1011 Raleigh Stormwater Assessment received a favorable report from the Senate Finance Committee and will be heard on the Senate floor next week.
HB 524 Annexation – Omnibus Changes was heard in the House Finance committee and an amendment was adopted that would require a referendum before an involuntary annexation could take effect. As of the writing of this update, the bill was not yet reported out of committee.

HB 323 Prevent the Theft of Scrap Metals enacted as SL 2009-200.
SB 1027 Zoning Change/Property Owner Notice enacted as SL 2009-178.
HB 239 Restore Water Quality in Jordan Reservoir enacted as SL 2009-216.

"My husband's more inclined to go shopping if we pass this bill."
Stated by Rep. Deborah Ross (D-Wake), urging a legislative committee to approve a bill that would allow brewers to offer free beer samples at grocery stores. We all may be more inclined to go shopping (hey, throw in some pizza while you’re at it)!
