Delay in Delivery of 2012 NC Residential Code Is Unfortunate, But It Does Not Provide A Legal Basis To Withhold Building Permits From The Public

During this year’s session of the General Assembly, Session Law (SL) 2011-269 was enacted setting a mandatory compliance date for the 2012 NC Residential Code and 2012 Energy Conservation Code of March 1, 2012.  The publisher will not have the 2012 NC Residential Code in print by that date. This requires the construction community to comply with several adopted code provisions on or after March 1, 2012, that are not currently available in a traditional code book.

Despite the fact that the 2012 NC Residential Code books are unavailable, builders and code enforcement officials can discover the necessary information at the websites listed below. This information can be combined to determine the new requirements of the 2012 NC Residential Building Code once it is published.

Residential building code updated

The N.C. Building Code Council has adopted building code amendments with varying effective dates. The amendments pertinent to residential construction are in theResidential Construction Code Amendments PDF to include mechanical and plumbing code amendments.  All other code amendments are in the Building Codes Amendments PDF.  These PDF documents include 2010, 2011 and 2012 amendments to the various codes. The effective dates can be found at the bottom of each code section.

NCDOI posts evaluations

The N.C. Department of Insurance Office of State Fire Marshall Engineering and Codes Division Evaluations Services Section has completed and posted the following evaluations on the OSFM Web site:

•  Cross Laminated Timber Construction
•  Spray Polyurethane Foam Insulation in Attic, Crawl Space, and Roofing Applications (Regulated by the North Carolina State Residential Code)
•  Trowel, Roller or Spray Applied, Water-Resistive Barrier for Exterior Walls

DOI evaluations are designed to be tools for building officials or anyone else who is looking for guidance on how to determine if a method or material is code compliant and can be approved for their projects. The utilization of the evaluation is at the discretion of the user as appropriate for their situation.

N.C. Energy Code Certificate

The 2009 N.C. Energy Code requires that a certificate be posted in the electrical distribution panel, inside the kitchen cabinet or other approved location. Contractors may use either form below to satisfy the requirements of the 2009 N.C. Energy Code.
